To the fullest extent permitted by law, you and Bon-ru agree that any dispute, claim, or controversy arising out of or relating to this website, Bon-ru products, orders, subscriptions, payments, communications, advertising, use of services, or these Terms shall be resolved by binding individual arbitration rather than in court.
You and Bon-ru each waive the right to a trial by jury and agree that any claim must be brought only in an individual capacity, and not as a plaintiff, class member, representative, or participant in any class action, collective action, private attorney general action, consolidated action, or representative proceeding.
The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that individual party's claim. The arbitrator may not consolidate claims or preside over any form of class, collective, consolidated, or representative proceeding.
If any part of this class action waiver is found unenforceable, then the unenforceable portion shall be severed to the extent permitted by law, and the remaining arbitration and dispute-resolution provisions shall remain in effect.
Nothing in this section prevents either party from seeking relief in small claims court where permitted, or from seeking temporary injunctive relief to protect intellectual property, confidential information, or proprietary rights.
These Terms shall be governed by the laws of the State of Wayoming.
